Please read the following general Terms and Conditions (“Terms and Conditions”)
Carefully as the provision contained herein shall govern your access and use of our online platform. This online platform is owned and operated by COZO (Hi Mama, Kuwait City, mirqab, Burj Altujjar, Floor 2) and its associates, related parties, successors. referred to as “Hi Mama”. This online application will be referred to as “Application”. Hi Mama is an online wholesale and retail application where you can order directly from our platforms, where we prepare and deliver. By downloading or otherwise accessing the application you hereby agree to be bound by the following general Terms and Conditions. There may be additional features on the additional Terms and conditions would also apply in the context of use of the Application along with these Terms and conditions.
1-General:
Terms and conditions applies on the below:
1. Any person accessing and downloading Hi Mama Application and website.
2. Any person registering through the Application by providing the below information:
Name, email address, delivery address, mobile number/ contact number.
3. As part of the registering process, you will create an account or log in through social media. It’s your responsibility to provide us with accurate information.
4. If you suspect that your personal information was disclosed to another party, contact us immediately. Kindly note that we don’t contact our users to confirm their username and password.
5. Your personal information is confidential and will not be shared with other parties. Except in certain case. (Please reference our Privacy Policy).
6. By accepting to our Terms and Conditions you become a user, we may stop providing you with the service if you don’t comply with our Terms and Conditions.
2 -Eligibility for Registration:
1. You are 18 years of age or older.
2. Your access to our application doesn’t violate the law.
3. You will provide accurate up to date information.
4. You must provide us with the accurate address and phone number guarantee an accurate delivery process.
3- Placing an order through our application:
Once you place the order you will receive a “confirmation” email that the order has been placed, please ensure that you provide us with the correct address and phone number to guarantee an accurate delivery process.
4- Delivery of products:
Hi Mama is a wholesale and retail application. You can shop directly from our application and we will deliver the products with the best service we can provide.
5- Exchange / Return policy:
1. All costumers have the rights to return or exchange items purchased from Hi Mama within 14 days of delivery of the item / order under the following conditions.
2. Returned items must be in their original packaging with all its original contents.
3. It should also be in the same brand box you received.
4. Returned items must be in a good condition and not used along with the original tag.
Note: Unfortunately, we have a no-return policy on some of our products. We recommend our customers to read the product description carefully before purchasing your desired order.
Refunds:
1. All customers have the right to receive their refund against returned items in the same form of payment made at time of the original purchase. if you purchased items by using debit / credit / K-net card, you will be refunded in the same payment method.
2. All customers have the right to receive their refund in full. We will not deduct any kind of transactions fees, such as Visa / MasterCard / K-net fees or processing fees, from your refund amount.
3. All customers have the right to receive their refund within 14 days of the original request. (Customer consumer rights / Kuwait law).
6- Price and Payment:
The price of any products will be listed on our application prices are liable to change at any time, but the changes will not affect orders in respect of which you have been presented with the Confirmation Email, or message. Whereby we will notify you as soon as we can about the pricing issue. You may be able to cancel your order once we notify you. Despite our best efforts, some of the products listed on our service may be incorrectly priced. Payment for all products debit card through our service. Once your order has been confirmed your credit or debit card will have been authorized and the amount marked for payment. Payment is made directly to Hi Mama.
We generally do not charge your credit card until after your order has entered the shipping process.
7- Intellectual property:
Intellectual property rights are only granted regarding your personal information or information uploaded on our application. Using our application doesn’t grant you intellectual property.
8- Comments:
Protecting other user’s rights and other reasonable restrictions.
1. You will not post any content or take any action on our application that break the terms of law on the rights of the other user or violates any law.
2. We reserve the right to remove any content or information if we believe that it violates these Terms and Conditions.
3. The use of any copyright and trademark or the use of any logo and trademark which is deceptively similar to the already existing trademarks without our prior written consent, we will disable your account when appropriate.
You shall not upload, post, email, transmit or otherwise make available through or in connection with the application any user content that may be (illegal, harmful, threatening, abusive, harassing, tortuous, defamatory, pornographic, obscene, libelous, invasive of another’s privacy, hateful, or racially, ethnically or otherwise objectionable; infringes and patent, trademark, trade secret, copyright or other proprietary rights of any party, comprises unsolicited or unauthorized advertising, promotional materials, “junk mail”, “spam”, ”chain letters”, “pyramids schemes”, or any other form of solicitation, except in those areas that are designated for such purpose; contains software viruses, trojan horse, worm, time bomb or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment).
9- Links to other websites:
1. Our service may contain links to third-party web sites or services that are not owned or controlled by Hi Mama.
2. Hi Mama must control nor responsibility for the privacy policy, function or practice of any other third-party service. Hi Mama shall not be liable, directly, or indirectly for any loss caused or claimed to be lost in connection or by or in connection with use.
3. We advise to read our Terms and Conditions and Privacy Policy.
10- Exclusion of liabilities:
- You expressly understand and agree that Hi Mama, its subsidiaries or affiliates shall not be liable to you for any direct, indirect, incidental, special, consequential, or exemplary damages resulting from.
1. The accessing of, or the inability to access, the application, the use of, or the inability to use of the application, all implied warranties, Terms and Conditions relating to the application.
2. Unauthorized access to or alteration of any of your transmissions or data, including any user content.
3. Any warranty, Terms and Conditions as to accuracy, completeness, and quality of the application.
11- Limitation of liability:
Hi Mama Company, nor its partners, employees, partners, suppliers, agents, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:
1. Unauthorized access, use or alternation of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

12- Site Policy and Modifications:
Please review our other policies, such as our privacy policy, available on
Hi Mama application. These policies also govern your use of Hi Mama services. We reserve the right to make changes to our site, policies, service Terms, and these Conditions of use at any time. If any of these conditions shall be deemed invalid, void, or of any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.
13- Copyright:
All copyright in all material available through application are owned by Hi Mama or its proprietary holders, particularly the photographs of the products, and you are required to abide by all copyright notices contained on the application. The user is under obligation to abide by the copyright notices and would be liable for any violation and Hi Mama hereby disclaims any liability in the regard.
14- Indemnity and protection:
You agree to fully indemnify, defend and hold Hi Mama, and its subsidiaries or affiliates harmless from any and all claims or demands, liabilities, damages, losses, costs and expenses, including reasonable attorney’s fees, made by any third party due to or arising out of your violation of terms and conditions, privacy policy or the right of others.
15- Third party beneficiary:
The registered user may not assign the registration or account to a third party as stated in the terms and conditions.
16- Violation:
Any violation, breach, transgression and infringement to the Terms and Conditions should be reported to by the user to Hi Mama by email: Info@himamakw.com
17-Termination:
We may terminate or suspend your account without notifying you or liability for any reason whatsoever, if you breach the Terms and Conditions without limitation, upon termination, your right to use our service will be ceased effective immediately, if you want to terminate your account, you may discontinue using our service.
18- Disclaimer:
Your use of the service is at your sole risk. The service is provided in an “AS IS” and “AS AVAILABLE” basis. The service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.
Hi Mama, its subsidiaries, affiliates, and its licensors do not warrant that:
1. The service will function uninterrupted, secure or available at any particular time or location.
2. Any errors or defects will be corrected.
3. The service is free of viruses or other harmful components.
4. The result of using the service will meet your requirements.
19- Governing law:
The terms and Conditions will be legally binding. Any dispute or claim arising out in connection with the Terms and Conditions will be addressed according to the laws of the state of Kuwait. You understand, agree and acknowledge that the courts of the state of Kuwait have jurisdiction to settle any dispute arising in relation to Terms and Conditions.
