Terms and Conditions of Hi Mama Company in accordance
with the Consumer Protection Law No. 39/2014
This policy is subject to the regulations of Law No. 39/2014 on consumer protection in the exchange and return of goods and merchandise and in accordance
with the decisions of the Ministry of Commerce and Industry regarding the
regulation of the consumer's right to exchange and return. The valued customers of Hi
Mama General Trading Company can exchange or return their purchases within 14
days from the date of purchase, within the following terms and conditions:
1.
The
goods/merchandise to be exchanged or retrieved must be in good condition,
displayable again, suitable for resale, and placed in their original packaging
with all their accessories and the original purchase receipt attached.
2. The customer acknowledges that he has not used the product in any way.
3. The nature of the product must be listed under the products that can be
returned or refunded.
4. Gifts given to the customer when purchasing the product must be returned
in a sealed package with full accessories.
5. The consumer shall return products in case of defect or malfunction or if
they do not conform to the specifications approved in the State of Kuwait.
6.
The customer must verify/check
the product when receiving it from the shipping/delivery company or the
delivery representative; if the consumer receives the product without any
reservation from the consumer, this will be deemed as an acknowledgment of the
product's safety, packaging, and any related matters and that it is in
accordance with his/her request.
7.
The consumer may not
exercise the right of return or exchange option in the following cases:
(A) If the consumer is aware
of the defect or defect in the commodity when purchasing it and accepting it in
its condition, this is evidenced in the purchase invoice.
(B) The nature, characteristics, and method of packaging or packaging of the
commodity or goods prevent them from being replaced or returned, such as being
damaged or impossible to return them to the condition they were in at the time
of purchase in such a way as to prevent resale, unless the reason for the
return and replacement is due to manufacturing defects or violations of
specifications, contrary to what was agreed upon as a result of fraud in
requirements and components.
(C) Consumer goods that are subject to rapid
perishability are excluded unless they are proven to be corrupt or have expired
for human consumption at the date of purchase, or goods manufactured based on
specifications specified by the consumer, books, newspapers, and magazines.
(D): Precious goods such as jewelry,
watches, glasses, leather that touching the skin (swimwear - underwear), and
perfumes are excluded from the return policy within 14 days and the return period for these items
shall be within 24 hours, provided that the option to return is written in the
purchase invoice is proved, and in all cases, the commodity shall be in its
original condition without any manifestations of use.
8.
Products purchased at
discounted prices during the promotion period can be exchanged within 14 days
from the date of purchase, and the cash value of these purchases cannot be
refunded if they do not meet the conditions set out above with the need to
bring the original invoice.
9.
If the customer returns
the product within the period allowed for the return process, the customer
shall bear the bank's commission applicable to the purchase, if any.
10.
If the exchange is not
possible, the product will be returned. The seller is obligated to refund its
value according to the value written in the sales invoice. Products that do not apply to the terms and conditions set out above will not be
returned.
